The committee members won round two of their battle with the association this week when the BFA DC stuck by its decision to set aside their suspension and ordered an immediate return to their positions.

They have been serving suspension since 2018 with the BFA alleging some financial irregularities on the part of the committee members. They were recently reinstated after the DC found that the mother body took too long to deal with the matter.

The committee members had approached the DC requesting for their suspension to be set aside since they had been on the sidelines for two years without a hearing.

Following the ruling, the BFA then took the matter further arguing that the DC chairperson, Martin Dingake made an error in determining a dispute between the two parties and purporting to order a dismissal of the charges on account of delay when he had no jurisdiction to do so.

The association also argued that the period of bringing disciplinary proceedings was limitless and therefore Dingake misdirected himself in finding that the delay was unreasonable.

The BFA requested the DC to uphold the committee members’ suspension until the investigations and proceedings have been concluded. However this week, the DC led by Dingake, stuck by its previous decision and ruled that the committee members be reinstated to their positions.

Speaking to Mmegi Sport yesterday, FDN chairperson, Mpenzeni Sambandawe, who was amongst those suspended, said they were happy to be back in office and deliver on the mandate given to them about two years ago.

He said for now they cannot say anything and would deal with matters that arise in the event the mother body appeals again.
