Notwane lost the play-off match 6-4 and were relegated to the second tier for only the first time since the club was established 50 years ago.

The club, through its legal representative, had argued that they were never granted a hearing by the BFA, thus asked the court to order that the BFA grants their wish.

Delivering the judgment, Justice Isaac Lesetedi said during the hearing of the appeal Notwane rightly conceded that the question of the play-off match was now water under the bridge in the light of what has since transpired. He further said that Notwane however argued that the CoA should continue to hear the appeal. Lesetedi said if the court was to judge in favour of Notwane it will create chaos in football as both the Premiership and the First Division leagues are already halfway through their seasons.

“The game has now moved onto the 2015/2016 season and is past midway. The only practical result of any outcome favourable to the appellant will create confusion in the ranking of the Premier League teams for the 2014/2015 season as to which teams would have been entitled to have a right to participate in the current season or those that would have relegated to the First Division,” he said.

Notwane however still have a chance to come back through the front door as they lie third in the First Division log with 18 points from 12games, seven points adrift of pacesetter, Black Forest.

Meanwhile, Gabonyaone ‘Shoes’ Selefa deemed surplus to requirements at BDF XI has since moved to Notwane. The utility-player scored a brace on his return in the past weekend. Toronto welcome Mochudi Rovers at the SSG grounds on Sunday in their next league fixture.
