Notwane are appealing a decision by the High Court to order a promotional play-off match between the team and FC Satmos in June last year.

The Premier League’s Disciplinary Committee (DC) had declared Sankoyo Bush Bucks’ striker, Morris Ruzivo a defaulter in their case against Satmos, a decision that saw the club being docked three points and two goals.

The Premier League reversed its decision to charge Sankoyo for the matches Ruzivo was involved in.

If the decision had not been reversed, Sankoyo would have lost 29 points.

Notwane lost the promotional match against Satmos 6-4 and were relegated to the First Division South League.

Motsumi argued the club were never given a hearing for their protest, hence why they find themselves in court.

“We seek that the court orders that be afforded a hearing by the BFA. We want the hearing to determine whether the play-off match was the right decision or not.

However, the outcome of that hearing will not be the matter of this court but an internal matter of the BFA,” he said.

Motsumi further said they want the hearing to reveal whether the constitutional rights of one of the parties involved were violated or not.

BFA’s legal representative, Mike Rasetshwane argued that it would be chaotic to revisit the events of last season as the current league season has passed its half way mark.

“The club played the match voluntarily and to revisit the matters of the last season may bring chaos to the football fraternity as the teams involved are now playing in two different leagues,” he said.

“This court cannot be drawn to resolve this matter neither the BFA can, but I argue that the matter can only be heard by the football governing body, FIFA,” he said.

The CoA will decide on the matter on February 4, 2016.
