The police immediately indicated that they were not in a position to determine whether or not the accused are illegible for bail.

The investigating officer in the case, Detective Constable Botshololeng of Goodhope Police Station told the court that the investigations were still ongoing therefore they could not determine whether the accused were bail candidates or not.

“We are not in a position to determine whether the accused persons are candidates for bail or not since the investigations into the matter are still ongoing,” Botshololeng said. The duo are alleged to have, on October 30, 2015 in Goodhope, broken into River Sand Liquor Restaurant and stolem music equipment worth P1,100 being the property of Banewang Entaile.

On count two, the duo together with Kebona Modise (52) who is still on the run, are alleged to have on the same day, in Goodhope  broken into Cruise & Cheer Bar stealing a Dstv decoder, music equipment, cigarettes and beer all valued at P4,500.

On count three the two brothers are alleged to have on November 7, 2015 at Serogwe cattlepost in Borolong, stolen a white Toyota Hilux valued at P35,000 being the property of Sentatlheng Mokgatitswane. Third accused person, Basimanebotlhe, told the court that he was not involved in a motor vehicle theft count, but said that the police only asked him to assist in locating his brother. He said he was later surprised when he was arrested and charged with motor vehicle theft.

Basimanebotlhe further said he wanted the police to hand him his cellphone and P400 cash which were confiscated from him during his arrest.

The investigating officer said he was surprised to hear such ‘lamentations’ from the accused person.  “I have been consulting the accused several times and I am surprised to hear such lamentations because he has never told me about his belongings.

Magistrates Tumelo Amos instructed the investigating officer to find if there were any confiscated properties belonging to the accused persons. The duo were ultimately granted bail on condition that should they fail to appear in court they will automatically have to pay P2,000
