Man, 57, Guilty Of Raping Minors

 

The convict, George Nduse, committed the two offences at Nata in 2010.

One of the victims is a niece of Nduse’s girlfriend while another stays in his neighbourhood.

Assistant Superintendent Lapologang Moatshe told the court that the prosecution was facing an obstacle because Nduse was refusing to provide a blood sample in order for an HIV test to be performed on him to ascertain his HIV status as the court previously ordered.

“The investigating officer told me that the accused refused to leave prison to go for an HIV test. I was further told that his reason for refusing to be subjected to an HIV test is that he had previously provided the prosecution with blood samples at the beginning of these matters,” said Moatshe.

Moatshe also stated that the prosecution informed Nduse that the reason why his blood sample was initially taken was to analyse his DNA for investigations and not to check his HIV status.

Moatshe added: “We pray that Nduse be further remanded in custody and he be ordered to submit his blood samples which should be obtained by force if necessary.” The presiding magistrate at the time, Kgololesego Segabo, had asked Nduse if he understood what the prosecution was saying to which he answered in the affirmative adding that he never refused to go for an HIV test.

Segabo had also explained to Nduse that the blood samples that were taken from him at the beginning of the trial were specifically for investigations and primarily for DNA.

“In terms of the law after conviction, the law provides that anybody who has been convicted of rape should undergo an HIV test. I do not want to order the police to use force on you in order to obtain your blood samples and I hope that you will cooperate.

If you do not cooperate, I have no option but to order them to use force to obtain the same. You shall come to court for sentencing this Friday,” said Segabo who has since joined the private practice.
