Wife Deserts Matrimonial Home

 

Ntwaagae came to court in mining reflector suit after her husband, Christopher Mabina, reported her for deserting her matrimonial home which consists of two minor children, despite a court order of October 13, 2015 which instructed her to return home. After weeks of non-appearance at home, her husband retraced his steps to the judicial offices and she was called to answer for contempt of court. Ntwaagae claimed that her husband was abusive and she could not be forced to stay with him as she has already filed for a divorce through her attorney.

Magistrate Odirile Mokgatle observed that courts of law will be rendered toothless if their orders are taken lightly.

He added that the public will lose trust in the judicial system if such attitude continues to prevail.“You have defied a court order and your disobedience will make people think that this court is a playground”, he said.

Makgatle noted that Ntwaagae has refused to return home to her children and husband claiming that he has issued her husband with a divorce letter, which further depicts that her attorney stands taller than the court.

He added that naturally courts of law are given first priority and he cautioned that Ntwaagae should not have given her divorce priority over her family which she seemed happy about.

Mokgatle said Ntwaagae was at liberty to report any physical and emotional abuse by her husband which he was cautioned about in the last sitting. He fined her P5,000, payable the same day or in default she will spend 14 days in prison.
