Zimbabwean charged for raping alleged girlfriend

The 31-year old Ndlovu is alleged to have, on October 2, 2015 raped the complainant, at Radisele village.
Ndlovu denied raping the complainant claiming that they were having an affair.
He added that at the time of the alleged rape he was not aware that the complainant was against sexual intercourse.
“We have been in a relationship for two years and I have been supporting her financially,” added Ndlovu.
The accused asked to be granted bail since he has a valid passport and resides at a traceable address in Botswana. Inspector Ditsapelo Emmanuel of Palapye Police Station who appeared on behalf of the state opposed the bail application saying that investigations are still at their infancy.
He also said that the state is in the process of locating the passport of the accuser to verify if indeed he is staying in the country legally.
In addition, he said medical examinations to confirm whether the accused was raped are yet to be completed.
In response magistrate Gofaone Mosweu said that it is not yet time for the accused to plead to any charges since investigations are still at an infant stage.
She added that the accused has to take note of the fact that a person can still rape his girlfriend.
“Being your girlfriend does not mean that you have a right to force her into sex,” she said.
Ndlovu will return to court on October 28 where he is expected to take a plea.
In another matter Mosweu gave 36-year-old Ontogile Simon a last chance to seek legal representative in a case in which, together with Mawela Morafe (33), is accused of breaking and stealing goods worth P60,000 at Maokatumo Post Office.
The stolen goods included Mascom, Orange, be Mobile airtime vouchers, postage stamps and cell phones.
According to the magistrate, Simon who is a taxi driver in Palapye, in one of his appearances sometime ago, requested to be given time to seek legal representation but to date he is yet to do so.
“If you fail to secure the service of an attorney in your next appearance the court proceedings will continue without you,” said Mosweu. The duo will appear in court on October 28.
