Raletsatsi suspended for misconduct

In a letter dated August 11, 2015, Malikongwa informs Raletsatsi that; “By my letter dated 11 July 2015, you were informed that the National Executive Committee of the Botswana National Youth Council was being dissolved with immediate effect and that as of that day, in your capacity as the executive director, you should report and be accountable to the Permanent Secretary Ministry of Youth, Sports and Culture”.
The PS said pursuant to the July 11 letter, on July 30, 2015, he addressed a letter to Raletsatsi directing him to carry out certain tasks as fully spelt out in the letter. “You responded to my letter on the 31 July 2015. In your response you informed me that you were not able to act on my instruction since the previous National Executive Committee of the BNYC had already made a resolution on the matter.
“This is despite the fact that part of the instruction given to you in my letter of 30 July 2015, I communicated that the resolution made by the National Executive Committee of the BNYC was irregular and was being wholly reversed and set aside.”
The PS stated that the other reason given by Raletsatsi for the failure to act on his instruction was that he [Raletsatsi] had separately sought legal advice from the labour office and “that you will be proceeding in terms of that legal advice”.
“I have considered your conduct in this matter, and it seems to me that such conduct constitutes serious misconduct (insubordination or refusal to obey lawful and reasonable instructions).
“I have therefore decided to investigate this matter further. Due to the serious nature of your conduct, you are hereby immediately suspended from duty at the BNYC pending further investigation. This suspension is on full pay,” said Malikongwa.
Raletsatsi was instructed that on receipt of the letter, he should immediately leave the premises of the BNYC.
During his period of suspension, Raletsatsi shall not enter the BNYC offices or attend to any business or affairs on behalf of the council without the express written permission of Malikongwa.
He shall not use or remove any BNYC property and equipment including computers or contact or instruct any employees on any matter relating to the investigations.
“Soon as the investigations are completed you shall be notified and advised of any intended further action. Please note that during your suspension you shall remain an employee of the BNYC and you are subject to the usual terms and conditions of your service,” he concluded. Raletsatsi has confirmed his suspension but refused to comment further.
