Incestuous father refuses to be fingerprinted � DPP

The man who is a former tribal leader in Masunga was convicted of raping his daughter at Newstands location in 2007. The assistant director of Public Prosecutions (DPP) Nomsa Moatswi told Siziba that she was unable to give the court previous convictions of the accused because he refused to board a car in order to go for  fingerprinting.

She added: “I apply for the accused to be fingerprinted to ascertain his previous convictions if any.  I shall call the police officer to come and tell the court why the accused was not fingerprinted”.

The attorney for the accused, Morgan Moseki, told the court that he had just been instructed to come and mitigate on behalf of the accused.

“I am not privy to why the accused allegedly refused to be fingerprinted, but I am not opposed to him being fingerprinted,” said Moseki.

Siziba ruled that the accused should be fingerprinted. The matter was adjourned to August 21 for mitigation and sentence. In his judgment a fortnight ago, Siziba said the state has proven its case against the accused beyond reasonable doubt although he denied the charge.
