Man denies raping four-year-old girl

The state alleges that the incident happened while the accused, Kago Mobeta, the victim and his girlfriend were sleeping in the same room.

Mobeta called his girlfriend Segametsi Maphosa to testify on his behalf.

Principal Magistrate Dumisani Basupi asked Maphosa to explain why she said that she had sex with Mobeta two times while Mobeta said that they did it three times.

Maphosa shocked the court when she said she didn’t see a difference between her having sex twice or thrice with Mobeta.

Basupi also took Maphosa to task, asking her to explain why she said she woke up around 5 am while Mobeta told the court that they woke up around 3 am.

In response, Maphosa stuck to her guns telling the court that she was sure they last had sex around 5 am because it was when she also woke up.

Maphosa told the court under cross-examination by Inspector Semakaleng Mazibane that the victim’s mother is the one who then entered the room and asked for toilet paper in order to wipe the victim’s private parts.

To which, Maphosa said, she responded by telling the victim’s mother to take anything dirty from the laundry basket to wipe the complainant’s private parts since they had no toilet paper in the room.

“I did not see that the complainant’s mother took the t-shirt that I had used to wipe my boyfriend’s private parts after we finished having sex,” said Maphosa. At that point, Mazibane asked her why she omitted to mention this in her evidence-in-chief.

Maphosa said: “I only realised that the victim’s mother used the t-shirt because I was busy on my phone after telling her to take anything dirty from the laundry basket.”

Maphosa further admitted that she also omitted to state that in her evidence-in-chief, but she said she did tell the police that at the police station when she was initially questioned in relation to the matter.

Mazibane then told Maphosa that she put it to her that what she said was an afterthought designed to mislead the court in order to protect her boyfriend. Mobeta told the court that he had no questions for Maphosa.

Judgement in the matter would be delivered on May 22.
