BOFEPUSU wants Public Service Act consultations

With announcement that the Directorate of Public Service Management (DPSM) will be reviewing its Public Service Act No 30 of 2008, Rari said the review should be done in good faith with the employee in mind.

In an interview, Rari noted that DPSM should not shy away from engaging the union through consultations, especially since certain provisions within the Act directly affected the public service workers.

“Provisions within the Act such as conditions of services and those that deal with administration issues should be put before us so that they can be thoroughly discussed for a way forward,” he said.

Rari explained that they have since received a letter last week from the DPSM indicating that they would be reviewing the Act in a bid to close gaps within it, of which he said they did write back asking that it should be tabled before the bargaining council. “I believe review of the Act is done in good faith therefore certain provisions in the Act should be bargained in good faith too by the bargaining council,” he said.

Rari however pointed out that there was nothing wrong with the Act being reviewed, stressing that loopholes may have been found, that needed to be closed. He further said no one who could prevent the Act from being reviewed or amended, if there was such need but said it would be wrong if the employer, does it only to oppress the employee.

“If there are gaping holes in the Act, the move to review it is highly welcome but we should all be on the same page so that no one feels disadvantaged when the Bill is passed,” he said.
