Mogapinyana man in court for murder

 

The State alleges that Kagiso Ofaletse stabbed Kagelelo Majwana, also 20 years old with an Okapi knife on the neck at the deceased’s home in Mogapinyana on Monday.

The prosecutor, Sergeant Mpho Nthabane, told the court that they were still investigating the matter hence he applied for the accused to be remanded in custody.

“The matter is still fresh. The Investigating Officer has not yet met most of the potential witnesses. Therefore, I make an application that the accused be remanded in custody until all the witnesses have been met.

If granted bail while investigations are at this early stage, he (Ofaletse) could temper with evidence or interfere with witnesses. Also, the relatives of the deceased are still very angry with the accused and hence baying for his blood.  Therefore remanding him will also save him from being lynched by the deceased person’s relatives,” pleaded Nthabane.

Nthabane further told the court that investigating officer was not available in court because he was at Nyangabgwe Referral Hospital where the post-mortem was being conducted. He said the results were expected today.  Ofaletse did not oppose the prosecution’s request that he be remanded in custody except that he made a curious plead to be remanded for only 12 days.  When the magistrate asked him why, he said it was because he did not kill the deceased intentionally and that the deceased was the one who started provoking him and started beating him. The accused will appear for mention on December 23, 2014.
