ATI faces possible lengthy sentence

“We had earlier indicated that we shall be amending the charge sheet.  We have amended it.  We have amended the second count in the original charge sheet,” she said. “Because of our new evidence in the matter, on the second count instead of assault common, the accused person will be charged with assault occasioning bodily harm,” Tirelo said.
Defence lawyer, Kgosietsile Ngakaagae, countered Tirelo’s revelations saying that the revised charge sheet by the state lawyer is an ‘incompetent amendment’. 
“It is more of a substitution as opposed to an amendment of the charge sheet, in the next mention we will be dealing with the legality of what an amendment means in the court of law,” he said.
Molemogi and his co-accused, Baboloki Phaga and Godiraone Motswedi, are alleged to have kidnapped and tortured by electrocution 29-year-old Nayang Ngwenya following a misunderstanding over gate-takings from a music festival in Serowe. If convicted ATI and his allies face a possible maximum sentence of 10 years in prison for abduction and kidnapping.  With the second count amended, another maximum jail term of seven years for assault occasioning bodily harm adds up to a total of 17 years of jail time.
ATI will appear before court again on December 15.
