Accused threatens to deal with police after term

He said that the bullets ended up hitting a vendor’s stall whose owner Unangoni he intends to call as his witness. The first prosecution witness, Modiri Sefako, a police officer who was allegedly assaulted by Kombani told the court that in December last year, they were assigned to go and arrest Kombani and his friend Itumeleng Sebolaaphuti in connection with a number robberies that were reported in their policing area.

He said when they found Sebolaaphuti at Botsalano Bars, in company of Kombani’s girlfriend, they took the duo to Monarch to help them locate Kombani.

Said Sefako: “We found Kombani at a shopping complex in Monarch and he tried to escape when he saw us. Another police officer in our company fired a shot in the air to stop Kombani from escaping but he kept on running.

I alighted from the car and gave chase but he did not stop. When I got near him, he picked up a stone and hit me on the face.

I withdrew my service pistol and pointed it in the air in a bid to scare him from attacking me.”

Sefako said that Kombani tried to snatch the pistol from him and a scuffle ensued between them.

He said the pistol accidentally went off and the bullet hit a 12 year-old boy Ronaldo Muzila on the back.

Added Sefako: “The boy was then taken to the hospital for medical attention while Kombani was arrested. Muzila has since fully recovered.”

Muzila testified that he saw Kombani picking something from the ground,  but he did not what it was. He said that he saw Kombani hit Sefako with it on the face.

He said that he escaped when he heard gunshots, but later found out that a bullet had hit him on his back.

Afterwards, Basupi said that the state had established a prima facie case against Kombani.

Basupi then ordered that Kombani should come to court on September 22 for continuation of trial.
