ATI ruling deferred yet again

The magistrate, who only returned to work yesterday was supposed to hand down ruling on an application for dismissal of case recently filed by Molemogi’s lawyer Kgosiitsile Ngakayaga. Ruling was initially scheduled for August 18 but was deferred to August 27. Yesterday it was postponed to September 3, 2014.

Molemogi and his co-accused, Baboloki Phaga and Godiraone Motswedi are alleged to have kidnapped and electrocuted 29-year-old Nayang Ngwenya following a misunderstanding over gate-takings from a music festival, earlier this year.

If convicted the accused would be sentenced to 10 years imprisonment for abduction and kidnapping, with a possibility of an added year for assault.

Following the series of postponements and late submission of evidence, Ngakayagae filed for the case to be dismissed. He argued that the stalled prosecution was a waste of time and resources.

He also submitted that the state had breached the court order by serving them summary of evidence on a date later than the one set by court, and had also given a short time to review the evidence. Mpathi Kgosietsile represents the prosecution.
