Mmadinare Trust seeks help against BDP council hopeful

MDT claims Mmadinare-Robelela council candidate, Sylvester Masweu, breached a contract the two parties had entered into for him to develop a strategic plan for the Trust. The deal was worth P22,980.

According to a letter signed by the Trust’s chairman, Moseki Moseki, the appeal to the District Commissioner follows “fruitless efforts” by trustees to compel Masweu to fulfil the deal.

“Masweu breached the contractual agreement and also failed to meet the December deadline to have delivered the final document,” Moseki wrote.

“He obtained the amount and was granted advance payments for phases he had not delivered on.”

The strategic plan was key in the Trust being better placed for partnerships and also to gain access to financial assistance from government and other institutions.

The Trust had already written to the Japanese Embassy for sponsorship to build offices that could be leased out for income generation.

“The Trust wants to widen its net through the strategic plan. The quality of the draft he initially presented was not properly done and the board recently held an emergency session where a decision was made to request the District Commissioner’s assistance,” he wrote in the letter.

Reached for comment, Moseki said Masweu had been unconvincing “in his excuses”, saying the Trust did not believe the delay was due to price escalations.

“He is not coming through. We were supposed to have the document in December last year after we were not satisfied with his draft. We communicated to Masweu both verbally and through letters and hence we were compelled to invoke the constitution,” said Moseki.

He explained that the Trust’s constitution allows them to seek the intervention of the District Office.

Contacted for comment, Masweu said the December deadline was impossible to meet because the board had failed to submit photographs required for the strategy on time.

“If it is breach of contract, then we are both to blame. Secondly I ran short of funds because I had under-quoted on the graphics. We had agreed that I do a strategic plan, not a document because graphics is not my domain,” he said.

Masweu said the strategic plan is ready but he needs money for the graphics, which “I know have to source for myself”.

 “The money I charged was as good as voluntary work. I do know that they have gone to the District Office,” he said.
