Witchcraft scare for defence lawyer in rape case

During a heated cross-examination, the witness whose name is withheld to protect the alleged victim blatantly told the court that he will bewitch Masilo’s lawyer. He said that Kgosietsile Ngakayagae does not have a conscience as he is defending a guilty man. The rape victim’s brother said this after Ngakayagae had continuously called the now angry man a liar.

“You have lied sir, you like exaggerating things. Why are you blowing things out of proportion? You lied,” said Ngakayagae. He quizzed the witness as to why he did not mention to the police that the man who had assaulted him had a prominent forehead with a flat nose. “How could you forget......because you said that at one point during your encounter with the man that his cap fell off. How could you not mention his prominent features?” Ngakayagae asked. The agitated witness responded: “You do not know what we have been through.

I saw the man I fought with. His picture is drawn on the canvas of my imagination. I will bewitch you. You just wait and see”.  Ngakayagae, who at this point had burst into laughter responded that: “God forsake, you do not know what I have been through. I have been to hell’s kitchen and I licked the pot clean”. Previously the witness had narrated to the court about his encounter with Masilo in August 2010. He said he had gone out with his wife leaving his sister and three-year-old son at home in Gaborone Phase IV.

He said that as is tradition, he went back home for lunch only to find the gate slightly open. He said that usually, his sister and son meet them by the gate and when they did not show up, he became suspicious.

He said that upon entering the house, he saw blood-stains on the living room floor and walls. In the corridor, he met a bloodied man who he later identified as Masilo.

He fought with him briefly before he escaped. He later found his sister’s naked body lying in a pool of blood and vomit, with his son standing by the bedside.

The case is before Chief Magistrate Lenah Oahile-Mokibe. It will continue on July 20 and August 29. The Monitor has learnt that the third witness will be the doctor who attended the alleged victim.
