It is expected that prosecutors will use the ballistic report and other evidence already forwarded by police to decide whether to pursue a court case against Moroka. The former Trade and Industry Minister has already been charged with the lesser offence of recklessness and negligence.

Yesterday, Southern Division Commander, Senior Assistant Commissioner, Oreeditse Mautle, told Mmegi that the DPP on Monday had requested that police submit the ballistic report.

He said the report would contribute to the DPP’s assessment of evidence in order to make a final ruling on whether or not to prosecute Moroka.  “On Monday we were requested by the DPP to submit a ballistic report. The report is almost ready and the DPP will have it by Friday (today),” said Mautle.

Moroka allegedly shot and killed a Tsabong man on April 22, 2014 at his farm, about 22 kilometres from Makopong in Kgalagadi District. It is alleged that Moroka killed the man after he mistook him for a dog.

Previously police said they had handed over the case to the DPP. Mmegi had also been informed that Moroka could walk free from the charges, which carry a two-year jail term or a fine.

Police have said Moroka is not facing more serious charges such as culpable homicide or manslaughter because there is no evidence indicating malice or intent behind the incident.
