DPP to decide on Moroka case

The Botswana Police have concluded investigations into the Neo Moroka shooting and handed over the docket to the Directorate of public prosecution (DPP) for determination.

Yesterday, senior assistant commissioner of police, divisional commander south, Oreeditse Mautle, told Mmegi that it is now up to the DPP to decide whether or not to prosecute the De Beers Botswana chief executive officer and former Minister of Trade and Industry. The docket was handed over on May 9.

“The police referred Moroka’s case to the DPP. Everything now lies with the DPP,” said Mautle.

Moroka allegedly shot and killed a Tsabong man on April 22, 2014 at his farm, about 22 kilometers from Makopong in Kgalagadi District. It is alleged that Moroka killed the man after he mistook him for a dog.

“The DPP, as the prosecuting body has the power to choose or to advise to proceed with the prosecution or to decline to prosecute depending on their assessment,” said Mautle.

When quizzed on why Moroka was facing a lesser charge of recklessness and negligence, Mautle explained that for one to be charged with murder there has to be evidence that there was intent to kill. He said that in this case there is no evidence that there was malice behind the incident.

The charge carries a two-year jail term, a fine or both.
