BNF renegades appeal to Dibotelo

Rex Seharane and Thomas Mhale are challenging Boko's leadership after he became the leader of the Umbrella for Democratic Change (UDC).  In a letter dated May 13, 2014 the two claim that judges may have been favouring Boko.

 'We have observed an ugly trend which has left us with a strong concern that there might be favouritism on the side of the judges towards Boko of the BNF. A clear example of the manifestation of such favouritism is the case in which Justice [Lot] Moroka dismissed against us an application but refused to give reasons for the dismissal.

 He only availed the unsatisfactory reasons after we had written a formal compliant to your office,' the BNF men say.

 Another example they cited is the matter in which Justice Terrence Rannowane ruled that there was no law compelling him to bar Tona Mooketsi from withdrawing as the first applicant in the case, 'even when his withdrawal had prejudicial effect on the rights of the remaining applicants'.

 They wondered whether the rights of Mooketsi and Boko are more important than those of the other applicants.

'We uphold the notion of the independence of the judiciary, where it is clear the judiciary appears to do things in an improper way, we believe we must register complaints with your office. All that we want to be done to our cases is justice, nothing but justice,' said Seharane and Mhale. 

They said if such favouratism is not checked, it would dent the credibility of the judiciary. 'We are ready to avail evidence to back up our case to demonstrate the validity and substance of our concerns.'

 They called for an investigation into the handling of their cases. Effort to reach High Court public relations office was futile at the time of going to press.
