Batshu told Parliament last week of the 64 registered trade unions, only 25 have complied and of the two federations of trade unions, one has not.  The only employers’ organisation has submitted annual returns.

He was responding to a question from the Member of Parliament (MP) for Ngwaketse West, Mephato Reatile on the status of compliance in submitting annual returns.

“The Trade Unions, Federation Trade Unions and Employers’ Organisations are required to submit annual returns by April 30, each year and this is in terms of the Regulation 12 of the Act,” said Batshu.

Reatile had also wanted to know from the minister the number of compliant and non-compliant organisations, and whether any remedial action has been taken in accordance with the Act to deal with non-compliance.

Batshu said between September 1 to 2, 2013 the ministry wrote letters to the defaulting organisations requesting they submit their outstanding returns by October 31, 2013.

“In addition, my ministry has instituted an investigation into the activities of 14 trade unions and federation of trade unions which have not submitted annual returns and their proper utilisation of funds in their possession found wanting by the Registrar,” said Batshu.

He further stated that letters of intention to cancel the registration have been issued to some of the organisations which have failed to submit the annual returns for two or more years.

“The organisations concerned were given two months from February 1, 2014 to March 31, 2014 to show cause why their registration cannot be cancelled and that responses from concerned parties would inform our next course of action,” said Batshu.
