Court throws out loan case

The court heard that Oodira had borrowed money from a motshelo which was supposed to accrue interest but Monametsi said he could not hear the case because that society was not registered.
Monametsi said all cash loans were supposed to be properly registered by the Registrar of Companies.
He told the Mabotseng that the court could only order the defendant to pay back the amount of money she owes him without interest. When asked how much he received from Mabotseng, Oodira told the court that she had paid him P1, 900. Monametsi dismissed the case saying that the plaintiff did not have a case unless he could provide documents from the Registrar of Companies. He said that rather, Oodira owed Mabotseng the P400 extra she had paid. He said that Mabotseng was the one who was supposed to take the complaint to court instead.
“I am deeply hurt because I was trying to help Mabotseng as a friend in time of need. I decided to borrow money from the motshelo hoping that she was going to pay back the full amount with the interest,” Oodira said. Oodira went home empty-handed after the case was postponed to February 12, 2014 after Monametsi asked him to bring the Registrar of Societies and Bank of Botswana documents as evidence that he or the motshelo group were allowed to give people loans.
