Notwane had sought an urgent application as the club’s supporters bid to wrestle the ownership from Mogapi who bought 80 percent shares of the team at the beginning of the season.
Dambe explained that the application was dismissed without prejudice to the applicant.
Notwane’s lawyer Kabo Motswagole told Mmegi Sport that the ruling did not mean that the application had been dismissed, but that it was not urgent. Notwane took the matter to court on December 27
He explained that there was still action that they could take and grounds for appeal existed.
Motswagole could not say much about the appeal before discussing the matter with his client. He said the decision of the court did not mean the end of the matter as they were still proceeding with the case.
Mogapi was not in court yesterday.
Notwane has been locked in a bitter ownership wrangle after selling shares to Mogapi.
However, the club argues that Mogapi has failed to stick to his end of the deal.
The expectation was that Mogapi would inject money into the club that has, however, experienced persistent financial challenges.
Mogapi arrived at the beginning of the 2013/2014 season amid much optimism, immediately signing former South African household names in the likes of Benedict Vilakazi and Manqoba Ngwenya. However, the situation at the club deteriorated such that the team relied on handouts to honour fixtures and salaries.
At one stage the team left Gaborone after 2:00 pm to play in Selebi-Phikwe, more than 400kilometres away, symbolic of the grave situation. Subsequently the team’s promising start on the pitch fizzled out and they have slid to position 14.
