Seretse files an application to quash charges

Seretse is charged alongside his associates Sharifa Noor and Alphonse Ndzinge. Their companies Kgori Capital and Kgori Holdings are listed as fourth and fifth accused in the matter.
Appearing before Regional Magistrate today for status update, State prosecutor Thabo Malambane revealed that they have received a new application from the first accused (Seretse).
“We have received an application from the first accused to quash charges, though today the matter was scheduled for taking pleas,” Malambane said.
According to papers seen by MmegiOnline, Seretse wishes the court could disregard the charges because Malambane has no right to prosecute.
“The Charge Sheet, presumably drawn up and clearly signed by Malambane as well as the charges set out therein, accordingly fall to be quashed and set aside,” he said.
Meanwhile, Seretse appointed a new attorney, Onalethata Kambai who pleaded with the court for more time to acclimatise himself with the application.
“We may require an amendment and we plead that the court give us time to amend or reply to the application made,” Kambai said.
Defence attorneys’ for Noor and Ndzinge also ralied behind Kambai’s submissions.
Both the State and Regional Magistrate Mareledi Dipate acceded to Kambai’s plea and set the matter for May 22nd for status update. The case continues.
