Accused DIS agent in fatal drug bust wants state to withdraw case

Amongst the six accused persons arraigned before the court is a DIS agent Keraamang, alleged to be part of the drug syndicate .
The five other accused persons are Phenyo Godisang (39), Tshepo Seakanyeng (38), Lebogang David (39), Artwell Mpofu (41), and Isaac Sinemba (35). They are all charged with three counts, one of which is giving false information to a person employed in public service.
Appearing before Extension II Magistrate today, State prosecutor Katlego Seema revealed that the investigations are nearing completion.
“We shall serve the accused with all the relevant documents before the next mention that includes the forensic affidavit so that the case can proceed to Case Management Conference,” Seema said.
However, the accused spy agent was not willing to take that lying down stressing that the Directorate of Public Prosecutions is playing a delaying tactic. “They are saying they are waiting for the affidavit but it is on record that they said they will serve us on January 25 this year but today here they are still saying the same thing,” Keraamang said.
Dismayed by the back and forth pronouncements by the State, the spy agent suggested that the State get their house in order or withdraw the matter.
“There is no provision for that sense. DPP is not ready and shall not shy away to withdraw the matter with liberty to reinstate so that they can be ready rather than repeating the same thing on every mention,” he said.
The agent also pleaded with Magistrate Kamogelo Mmesi to assist him to reclaim his property from police officials.
“May the court assist with my property which includes my phone as they are refusing with and to my shock it has not been done so with my co accused. Their properties has been handed back and with me it’s a problem and I don’t know why,” he said.
The spy agent was seconded by defence attorney Modisa Kebonyemodisa to withdraw the matter with liberty to reinstate whilst they 'get their duck in a row'
“I share the same sentiments with the first accused that we are on record that should we not make progress this matter will be withdrawn. Matters are not brought to court to investigate and it is becoming apparent it is not only the affidavit that is outstanding,” Kebonyemodisa said. After listening to the two sides, Magistrate Mmesi said she will consider withdrawing the matter with liberty to reinstate on the next mention.
“The matter is adjourned to March 30 and prosecution was given up to January 26 to have served the defence with all relevant documents but will be given indulgence until next mention. Should they fail to do, the case will be withdrawn. The issue of properties will be heard on March 2nd,” she ordered.
The background of the matter is, DIS agent Keraamang, an accused alongside Godisang, is alleged to have, on August 4 2025 at the Central Police Station, acted together and gave false information to police officers, causing them to act on their lawful powers, knowing very well that the information was false.
On second count, all six accused persons are charged with unlawful possession of an illicit substance (dagga) at the GSS grounds where the shooting took place.
On the third count, accused Seakanyeng, David, Mpofu, and Sinemba are charged with assaulting police officers in the execution of their duties. The quartets are alleged to have assaulted officers at the GSS grounds with a 55cm brown sable knife, pepper spray, and a small axe.
