Rape accused refuses to provide DNA two years on

Loeto appeared before the Extension II Magistrate's Court this morning for two counts of rape. The State revealed that there have not been any developments in the case as they are moving at a snail's pace, because Loeto refused to comply.

“To this date, the accused is still refusing to provide his DNA sample, which we will use to profile whether or not he is indeed the man we are looking for in the rape charges, but he is not complying,” State prosecutor, Simon Galebonwe, said.

The State further submitted that since the Loeto is making their job difficult, he should further languish in custody. “With all that, we apply for the accused to be further remanded in custody and we set another date for status update,” the state said.

Asked by Magistrate Keabetswe Majuta, the accused, Loeto, said the State is simply trying to implicate him for crimes he does not know. “All these people are trying to coerce me into these crimes. I have always maintained that I do not want to provide my sample if everything is not done right,” he said. The Magistrate assured the accused that all proper channels would be followed and he should assist the court by providing his sample so that he could clear his name if he is not guilty. Meanwhile, Magistrate Majuta further remanded the accused in custody and set the matter for January 27 for a status update.
