P12m corruption case committed to High Court

The P12 million tender case involving Assistant Accountant General in the Ministry of Finance, Moses Moreri, has been committed to the High Court by the Regional Magistrate Court.

The top government accountant faces charges of corruption and abuse of public office contrary to Section 2A (1) and conflict of interest contrary to Section 31 (1) (b) of the Corruption and Economic Crime Act. According to court documents, Moreri is alleged to have influenced the outcome of the appointment of Nexim (Pty) Ltd, in a tender worth P12.5 million, which was for the procurement of Oracle Super cluster (M7-8) Server Machines. His involvement stemmed from the accusation that he did not declare his friendship with the company director, who was eventually awarded the tender. When the matter came before the Regional Magistrate Mareledi Dipate, the State submitted that their wish is to commit the matter to the High Court for trial despite initially registering it with the regional court.

During the last court appearance, the State encountered resistance from the defence team who argued that there was need to move the matter to the higher court for trial. One point of contention was that the State had not yet furnished the defence with all the necessary documents for committal. However, on the contrary State prosecutor Mmapatsi Tshimologo informed Dipate that they had already shared the documents with the defence team. In court today, Moreri’s attorneys agreed with prosecution to move the matter to the High Court following the State prosecutor’s submissions that it be moved. “I do confirm that prosecution has furnished us with all the necessary documents and we have no problem with it to be committed to the High Court,” defence attorney, Onalethata Kambai said.

With the defence and prosecution in agreement this time around, the regional magistrate committed the matter to the High Court for trial. “The accused is hereby committed to the High Court to stand trial on the charges that he is facing and he will remain on bail until then,” ordered Magistrate Dipate. The trial dates are to be set by the High Court once the committal documents are ready.
