TO: SIRIVA PHIRI, an adult male of full legal capacity whose last known residential address is Plot 32382, Thebe Lane, Molapo Estates, Francistown and whose address for purposes herein is P. O. Box 13, FRANCISTOWN.

TAKE NOTICE THAT by Notice of Motion issued out of this Court, you have been called upon to give notice within Seven (7) days after publication hereof, to the Registrar of the High Court of Botswana and to Mogale Legal Practice, Krystal House, Plot 1504, Area G, Cnr Guy Street & Feitelberg Street , P.O. Box 931, Francistown, Botswana (Applicant’s Legal Practitioners) of your intention to Oppose (if any) and thereafter within (14) fourteen days of publication to file an Answering Affidavit, if any, in a claim wherein the Applicant seeks relief against you in the following terms:

A Court Order in the following terms;

a) Confirmation of the cancellation of the Agreement entered into between the Applicant and Respondent on or about the 27th November 2018;

b) Directing, ordering and authorizing the Deputy Sheriff to attach and repossess and deliver to the Applicant a 2018 MAZDA CX5 motor vehicle, with registration number B 597 BIR, chassis number JM6KF2W7AK039370 and engine number PE10638156 from the Respondent or any other person(s) claiming title through the Respondent;

c) Directing that the Respondent to pay the costs of this Application on an attorney and own client scale;

TAKE NOTICE FURTHER that if you fail to give such notice, a Court Order may be granted as above stated without further reference to you.
