Gweta man awaits judgment for girlfriend's murder

The State alleges that Nsununguli Lewanika, 42, of Gweta village in the Central District murdered Shashamulani Bango on October 7, 2017, at Xhinixhwa cattle post near Gweta and based on the first impression of evidence presented and accepted as correct was not proven otherwise.

Lewanika through his attorney, Luanda Antonio, had previously made an application of no case to answer after the prosecution closed its case.

Delivering a short ruling on the matter, Justice Lot Moroka said: “Without going into the minute details of evidence, from the evidence adduced in court, all the basic ingredients of a prima facie case in this matter have been revealed. I consequently find that the conduct of the accused caused the death of the deceased. Therefore, the accused has a case to answer.”

Asked by the judge what options of defence his client chose going forward, counsel Antonio said: “My instructions are that the accused shall exercise his right of remaining silent and he shall not be calling any witnesses. This will also mark the end of the defence case.”

Judgment in the matter will be delivered on April 18, 2023.
