Kenyan drug trafficker appeals sentences

Magistrate Kose Makobo sentenced the appellant, Abas Ndyanabo Ismail, on July 6, 2021, in Kasane for the illegal possession of heroin and dagga.

Ismail was sentenced to seven years in jail for unlawfully trafficking in heroin and another five years for trafficking in dagga.

The trial court ordered both sentences to run concurrently. In addition, Makobo made an order for Ismail to pay P30,000 and P20,000 for possession of heroin and dagga respectively.

Ismail was ordered to have paid the fines by 3:30pm on that day which he has since paid.

Ismail’s attorney, Themba Joina told Justice Barnabas Nyamadzabo that it appears that the lawyer who was previously instructed by the applicant has some documents in his possession which are not available to him.

Joina added: “It will be in the best interest of my client for us to file other supplementary heads of argument.”

Prosecutor Goabaone Motlhagodi told the court that he agreed with Joina’s submissions.

Justice Nyamadzabo then made an order for the appeal against the sentences to be heard on September 2.
