Daisy Loo case tomorrow

 

Mmegi learnt over the weekend that the case was handed over to a new presiding judge, Justice Walia.

The judge talked to the attorneys representing Daisy Loo and the government asking to be allowed time to read the Court documents which number 3000 pages.

Mmegi learnt that both Tshepo Motswagole, the assistant attorney general, representing the Government and Peter Collins, representing the provisional judicial manager of Daisy Loo, and Mac Bahuma attorneys, whose trust account holds the disputed 25 million Pula cheque, both agreed that Wednesday would be the ideal date for the case.

Mmegi learnt that both attorneys concur that it was important that the new presiding judge understands the case and as such he would need to read the first  Appeal's Court judgement, as well as the July 27 High Court case filed by the state before Justice Newman, as well as the current application filed by Mac Bahuma attorneys and Daisy Loo judicial manager.

The applicant seeks the High Court to hold the Directorate of Public Prosecution (DPP) and the Directorate on Corruption and Economic Crime (DCEC) in contempt of court arguing that they have acted against the order of the Court of Appeal by overturning his decision at a lower court.

The applicant also argues that the DPP had acted against the High Court order of last week Wednesday which ordered the DPP never to file a similar application  seeking to withhold Daisy Loo's money as exhibits in their criminal investigation, until they have paid the punitive costs.

The taxation of the punitive costs against the state started on Thursday last week but were interrupted when the presiding Justice Gaongalelwe also needed to have the same file for use as he prepared to hear the case on Friday. .
