DIS expedited appeal denied

DIS, who wanted to appeal on urgency after they were denied the search warrant by Lobatse High Court judge Ranier Busang, will have to go through the normal court process for the appeal.
This morning, Justice Monametsi Gaongalelwe told the DIS that their application has been denied since there are no extraordinary circumstances for granting an expedited appeal.
“Application for the expedited appeal is refused. The appeal will be allocated a date of hearing by the registrar of this court in its turn like all appeals. The cost of the application will follow the outcome of the appeal,” he said
The DIS, who wanted to be given access to Khama’s property through a search warrant, told the CoA on Friday that they believe weapons of war have been hidden in Khama's safe.
They approached the CoA seeking leave to appeal on an urgent basis the Lobatse High Court judge Busang’s ruling sometime back that denied them a search warrant at State House 4.
According to the spy unit, they believe the former president smuggled weapons from the DIS armoury into the safe in his house making it difficult for them to collect evidence for investigations.
Prosecutor Sifelani Thapelo said when they searched the armoury they found nothing incriminating despite knowing that the weapons were initially there.
Khama’s lawyers opposed the move saying the unit wants a second bite at the cherry.
Attorney Unoda Mack told the court that the DIS was operating on dishonesty as it has failed to disclose crucial information to the court.
