Magosi, who obtained a warrant to search for and collect weapons at the former president’s various residences says he has no obligation to collect guns from Khama as he claimed in his letter addressed to the spy chief.

“We deny that there is an obligation for us to collect the firearms. In that respect, we advise that your client hand over the said firearms to the DIS investigating officer not later than Monday 8, 2021, noon,” reads the letter.

According to the letter, Magosi explained that Khama has a legal obligation in respect to the firearms that are registered in his name.

He said Khama could do so in the presence of his legal team during the handover.

However, by noon Monday this week, Khama had not handed the guns as he had travelled outside the country.

His legal team said the letter was received while he had already travelled.

Meanwhile, Magosi’s response follows a letter by the former president last week where he told the director-general that he will not deliver the weapons to his Sebele office.

Khama through his lawyers, Ramalepa Attorneys had written a letter addressed to Magosi asking him to collect the weapons as agreed.

“Former president will not come and deliver the weapons to your office, you should instead come and get them as was agreed on Saturday, October 23, 2021,” reads the letter.

According to the letter, the former president told Magosi that the weapons were still under the care of his officers at his residence and that he may contact him for a handing over of the same at a time of his pleasure.

Khama explained that it was mind-boggling that the director-general has not come to collect the weapons but asked him to deliver them after claiming a threat to national security.
