According to the police, the accused allegedly had sexual intercourse with his daughter on various occasions in June 2020 and July 2021 at the residence of his daughter’s mother at Block 2.

He was caught in the act by the mother of his child having sexual intercourse with his daughter.

The accused’s girlfriend was awaken by erotic noises at night only to see the shock of her life when she saw the accused having sexual intercourse with his child.

The accused made an application for variation of his bail conditions when he appeared in court on Monday before Magistrate Thabang Chokwe.

The accused prayed with the court to vary his bail conditions of paying P1,000 and bring two sureties who shall each bind themselves with P1,000.

“I cannot raise the P1,000 that the court said that I should pay in order to be granted bail hence I am humbly asking the court to make an order that I should bind myself in the same amount. I have no problem with other conditions that the court has set,”pleaded the accused.

The court had initially made an order that the accused shall pay P3,000 but changed that bail condition after the accused prayed for variation of the bail condition.

He said that the P3,000 was too steep for him to raise since he was in jail.

The court acceded to the application and made an order that the accused shall pay P1,000.

The man had previously pleaded guilty to the offence when he appeared before court for arraignment.

However, his plea was reserved because investigations in the matter are not yet complete.

When the accused appeared before court for mention, sergeant Keneilwe Moriti told the court that they are still waiting for some exhibits from the police forensic laboratory.

However, Chokwe did not accede to the application for variation of bail conditions.

Chokwe said: “Considering the severity of the offence that the accused is facing, I cannot vary his bail conditions. The accused is further remanded in custody until he fulfils his bail conditions. He shall appear in court again January 20,2022 for mention.”

During the accused’s other appearance in court, he prayed with the court to grant him bail saying that although he committed the offence, he is an anti-Gender Based Violence (GBV) advocate.

He also emotionally told the court that the effects of having sexual intercourse with his daughter were overwhelming him ever since he committed the offence.

“I admit that I knowingly had sexual intercourse with my child but I am asking to be given an opportunity to go and take care of my children. I am also asking the court to make an order that I should go and consult professionals for psycho-social counselling. I don’t think that I could just change overnight and commit the offence that I committed,” a visibly emotional man pleaded.
