Ditshenyo simultaneously looked puzzled and remorseful after a verdict of 'guilty' was passed against him for the 2017 murder of his mother’s live-in partner, Odidimetse Radipotsane in Basimane ward in Serowe. When delivering judgment, Justice Lot Moroka, said evidence shows that Ditshenyo went on a rampage when he committed the offence. “The accused first attacked Olebogeng Ntshontsho and attempted to rape her. He took her cellphone and as she screamed, the accused’s sister Oratile Nnanako tried to assist Ntshontsho.

The accused then attacked his sister after Ntshontsho escaped. He pelted his sister with stones until his sister ran away from home. Hearing commotion that sounded like the throw of stones outside, the accused’s mother told others who were within her compound that they should seek refuge inside. However, the deceased did not heed the advice of the accused’s mother and chose to remain outside,” Moroka said.

After other people who were outside the compound ran inside, the accused followed them and violently opened the door which caused his mother who was holding the door to fall, Moroka said. “Sensing danger, the accused’s mother and other people who sought refuge inside the house got outside and ran to a neighbouring home. After they returned to the accused’s mother’s place, they found the deceased lying down on the ground motionless. The deceased was later taken to the hospital where he was certified dead. The post mortem report shows that he died as a result of blunt force as a result of an assault,” said Moroka.

Moroka added: “In this case, basic facts point to the accused who was in assault mode as the person who murdered the deceased. The accused disrespected his mother and also assaulted his sister. If by extension he could not respect his mother, it shows that he is the one who assaulted the deceased.

I have therefore come to the conclusion that the state has proved circumstantial evidence against the accused beyond reasonable doubt. Consequently, the accused is found guilty of murder as charged.” Ditshenyo will appear in court on November 17 for mitigation and sentence.
