LSB to charge Mokgethi

Mokgethi, who is a lawyer by profession, will be defending herself against LSB disciplinary committee on a misconduct charge. LSB executive secretary, Tebogo Moipolai Tuesday this week said: “We have forwarded the judgment from the Court of Appeal to the disciplinary hearing committee which will decide whether or not to charge Mokgethi with misconduct. I cannot make an assumption on the charges that Mokgethi will face or what the disciplinary hearing will rule regarding the judgment.”
He however, said the meeting which will be held tomorrow will decide on some issues that normally are raised by complainants and later the media make inquiries on them. He continued: “It is not our norm to discuss any complaint that is still before us because we have to investigate it first. Some of the allegations are meant to tarnish other people’s names while there is no substance of allegations.” Moipolai also said every case needs to be investigated first before the Law Society could make a comment on it.
This came about after one of the surviving grandsons of the late Joseph, whose estate is a subject of a court battle between Minister Mokgethi and his children, has accused the Law Society of Botswana (LSB) of ignoring his complaints about the politician’s conduct. In a letter dated September 13, 2017, which he wrote from the United States of America where he is based, Dawn Masenya accuses Mokgethi of "forging my signature in a transfer document (my grandfather had gifted me a small farm)."
“I was not in the county on the date of the signatures. The police department and the Law Society of Botswana have not responded to my request to take action against Mokgethi," said the letter Masenya had written to the LSB.
He added: "In September 2017, I wrote a letter to yourselves with five attachments to which there is yet to be a response. The attorney‘s integrity has been put into disrepute and the issues must be promptly resolved to give effect to the judgment. I cannot help but I am concerned that the LSB is protecting its members against legitimate and pressing complaints.” Masenya had also complained that, "the attorney’s acts were based on blatant and gross dishonesty to attempt to evade the ultimate findings of the Court of Appeal (COA)."
According to court records, Joseph died on July 7, 2012, and Mokgethi was soon thereafter issued with a letter of administration of his estate. Joseph had drawn up a will about two years before his demise. This was executed by Mokgethi who was his attorney, and who was also named therein as the executrix of his estate.
