Child Maintenance Fee 'Defaulter' Rambles In Court

FRANCISTOWN: A man rambled so incoherently that Chief Magistrate Mokwadi Chris Gabanagae could not help adjourning the court on Friday as he said his head was "swimming".

Bespectacled and constantly licking his lips, Manchester Sandy had been given a chance to cross-examine Idah Mositwane who had brought him to court for failure to comply with a court order to pay child maintenance fees. Instead of firing questions at Mositwane, bald-headed Sandy, who insisted on speaking in English and seemed to relish unleashing bombastic words, started off rambling about how he was taking care of the children. But it was when he said 'I know what I am talking about because I incapacitated the prosecutor,' that Gabanagae started questioning his state of the mind. "Do you understand yourself?" Gabanagae asked. But Sandy rambled on until a court orderly stood up and banged on the table saying: "You have been requested to cross-examine the witness, but you are irrelevantly addressing the court." That momentarily took the steam out of Sandy who stood licking his lips. And then he soldiered on with questions that began with "Do you remember..." Do you remember...?' He asked Mositwane whether she remembered that he paid P6, 000 in November, last year to which the latter scratched her head and she too tried veering off with her own rambling until the magistrate asked her to be clear whether she got the money in November. She responded in the affirmative. And then Sandy dropped the bombshell: "Do you remember when I told you that you did not have the qualities of a woman one would call a wife?" That clearly peeved Gabanagae who said he suspected Sandy to be drunk and he wondered about the logic behind such a question in relation to the matter before court.

The next question evidently drove the magistrate out of the court as the audience gallery looked like they were watching a situation comedy ala Friends. "What forced you to believe that I would have more money to take care of your kids in spite of the fact that I have a wife and children to look after?" When Ganabagae asked him to clarify himself he licked his lips again and said: "Can you tell this beautiful court the condition of the kids...?" He could not finish the question as Gabanagae interjected and asked what "conditions" he was he talking about.
