New date for Mogae court case

The high profile case involving ex-president Festus Mogae, top serving and former government officials and prominent businessmen will resume before Justice David Newman of the High Court on December 7.

The case failed to proceed last week because it had been omitted from the court roll. Besides Mogae, some of the top figures featuring in the case are Chief Justice Julian Nganunu, Assistant Minister Charles Tibone, Mogae's one-time right hand man, Lawrence Lekalake, former permanent secretaries, former ambassadors and prominent businessmen most of whom have connections in the corridors of power.

At the centre of the dispute is the battle for the shares of 21st Century Holdings. The case arose after a high level deal went awry, leaving top figures facing-off in court. In one corner is Tibone, a renowned businessman and Lekalake. In the opposing camp is Mogae himself, Nganunu, Legwaila Legwaila, businessmen Sam Mpuchane, McClean Letshwiti, Nkobiwa Sebele, Goabaone Mokama, Tshipa Mothibatsela, Ludo Makhwade, Letlhogonolo Dabutha, Alfred Dube, Dikokole Mosinyi and Dzene Makhwade-Seboni. There is also Kgarebe Investments owned by Aloysius Kgarebe, JDM Investments - a company owned by Nganunu and his son Dziki, Letshwao Investments owned by Lesego Selotate and Lawrence Khupe, FGM Investments of Mogae, San Safaris of Emang Maphanyane, Tsela Alliance represented by Matenge Matenge.

The Mogae group got wind of an emergency general meeting of 21st Century Holdings in June 2008 where a resolution to remove Mpuchane, Letshwiti, Maphanyane and Khupe as directors was to be mooted.

The Mogae group filed an urgent application in court and succeeded in forestalling the resolution from being taken by Tibone and Lekalake. Lawyer Tshepiso Lediretse represents Mogae's camp, while South African attorney, Cyril Ziman, represents Tibone, Lekalake, Liyanda Lekalake and 21st Century Holdings.
