Eminent VIP case 'only after April'

The high profile corporate case involving former president Festus Mogae, Chief Justice Julian Nganunu, incumbent and former ministers and permanent secretaries is likely to go for trial at the High Court in Lobatse only after April next year.

Attorney Neil Armstrong says they are likely to set trial dates after April 29 next year because there are still a lot of "crucial" evidential documents that the lawyers involved need to exchange. "We still have to find those documents before we go to trial," says Armstrong. 

Cyril Ziman, who represents incumbent Minister of Finance Charles Tibone, Lawrence Lekalake, Liyanda Lekalake and 21st Century Holdings, concurs with Armstong and is hopeful that by that time, all documentation that needs to be filed in court will have been completed. The case is before Justice David Newman.

At the centre of the controversy is the battle for company shares among the business partners. The other partners in the dispute are Assistant Minister Charles Tibone and Mogae's one-time right-hand man, Lawrence Lekalake. The case arose after a high stakes deal went awry, leaving top figures facing-off in court. In one corner is Tibone, a renowned businessman, and Lekalake.

In the opposing camp is Mogae himself, Nganunu, Legwaila Legwaila, businessmen Sam Mpuchane, McClean Letshwiti, Nkobiwa Sebele, Goabaone Mokama, Tshipa Mothibatsela, Ludo Makhwade, Letlhogonolo Dabutha, Alfred Dube, Dikokole Mosinyi and Dzene Makhwade-Seboni. There is also Kgarebe Investments owned by Aloysius Kgarebe, JDM Investments owned by Nganunu and his son Dziki, Letshwao Investments owned by Lesego Selotate and Lawrence Khupe, FGM Investments owned by Mogae, San Safaris of Emang Maphanyane, and Tsela Alliance represented by Matenge Matenge.

Mogae and his companions got wind of an emergency general meeting of 21st Century Holdings where a resolution to remove Mpuchane, Letshwiti, Maphanyane and Khupe as directors on June 10, 2008 was to be mooted. They then approached the court on June 9 with an urgent application to forestall the resolution from being taken by Tibone and Lekalake. The applicants - Mogae and company - succeeded in their application.

Attorney Armstrong appears with Tshepiso Lediretse for Mogae and his companions, while South African attorney Ziman represents Tibone, Lawrence Lekalake, Liyanda Lekalake and 21st Century Holdings.
