Statement disappears in Nchindo case

In yet another twist in the dramatic Nchindo graft case, the prosecution has revealed that a statement from one of the key state witnesses has gone missing. The prosecution said yesterday that the statement from De Beers' head Nicky Oppenheimer cannot be found and the state has launched a search to locate it.

The prosecution and the defence in the case are involved in a tussle over statements of key witnesses. The defence wants to have access to the statements. But the prosecution says it has already availed what it has to the defence.  "We maintain that those (statement) taken have been availed and those not, have not been availed," the prosecution stated.

Besides the statements, Nchindo's legal team led by advocate Peter Hodes wants to quiz the current President Ian Khama, former president Festus Mogae, Oppenheimer, Vice President Mompati Merafhe, and cabinet ministers Daniel Kwelagobe and Phandu Skelemani. Hodes said yesterday that Khama's statement is related to the charge that Nchindo and others acted together and gave false information to the president in order to acquire plot 5572 in Gaborone.

Hodes told the court that the defence wants to be given an opportunity to interview Khama, Merafhe, Kwelagobe and Skelemani

to know what the witnesses will say when the trial gets under way.

The defence countered that these demands should be met tomorrow when the case resumes or later. Yesterday, the defence asked the court to postpone the commencement of the criminal trial from tomorrow to July 2009 or any other date agreed between the two parties.Former Debswana managing director, Louis Goodwill Nchindo, ex-group secretary, Joseph Malope Matome, former Debswana communications chief, Jacob Sesinyi and Nchindo's son, Louis Garvas, are before the Gaborone Village Magistrates Court to answer 32 counts of corruption.The case has been adjourned till tomorrow when the state is expected to respond to submissions made by the defence team. The prosecution is led by principal state counsel, Matlhogonolo Phuthego and senior state counsel Kgosietsile Ngakaagae, while the defence team is made up of  Hodes, Lawrence Khupe and Parks Tafa of Collins and Newman.
