One granted bail in Davids murder case

One accused person in the murder case of Mochudi East legislator, Isaac Davids, has been granted bail.

The second accused Ramotswa-born, Mokgalemi Maleya was granted bail this morning by Molepolole Magistrate Court. Maleya, represented by Mishingo Jeremia, had it easy when the state did not oppose his bail.

He was advised by the court to adhere to his set bail conditions, which among others include binding himself with P2,000 together with two sureties with the same amount each, surrendering his travel documents, reporting to police as set by court and not travel outside the country without permission from authorities.

Still on bail, the first accused, Zimbabwe-born Jabulani Dube will remain behind bars until February 27, 2018 when his bail ruling will be delivered. 

Represented by Sesupo Masaka, Dube was not lucky today as the state opposed his bail for the one reason that he might skip the country.

This was despite the state through the investigating officer, Diane Lentigetse admitted

that the accused had all valid documents, has a brother who works in the country, a son and a girlfriend in Serilatholo.

His lawyer Masaka did not take kindly to the state submission citing discrimination based on nationality. 

“Bail has no discrimination.  It is not given based on citizenship. The police are opposing bail for my client only based on fear of what might happen, which is not how it works in a court of law.  All evidence points that my client has relations in the country and has all valid documents,” Masaka countered the state opposition.

Masaka said that all accused persons should be treated equally as they are alleged to have committed the same offence.  The two accused persons who are his two farm workers at Serilatholo village near Letlhakeng allegedly stabbed him to death in January.
