BLLAHWU threatens to sue govt

Botswana Land Boards, Local Authorities and Health Workers Union (BLLAHWU) has threatened the Directorate of Public Service Management (DPSM) with legal suit should it continue refusing to effect burial cover for its members.

The union has written to DPSM requesting them through an ultimatum to honour its obligation and adhere to an agreement between the two parties regarding burial cover for its members.

Nonetheless the union’s burial society continues to fight for its members that are said to be without cover since DPSM allegedly failed and neglected complying and cooperating.

In a letter dated September 28, 2016 from the union directed to DPSM Director Ruth Maphorisa, the union said their members are without cover due to their failure to effect deductions despite numerous communications.

Dingake Law Partners, on behalf of the union, explained that members are entitled to the cover as per the union’s constitution, the Trade Unions and Employers Organisation Act and the Recognition Agreement entered into by the two parties in March 2009.

The letter reads, “The union members are part of a scheme subscribed with Metropolitan Botswana. In terms of Section 6.3 of BLLAHWU constitution, the membership is compulsory.

The members have undertaken to abide by the constitution and agreed on a monthly subscription to be deducted from them.”

The union said despite the two letters dated August 2, 2016 and September 8, informing DPSM about the decision taken to make the scheme compulsory and requesting deductions DPSM has failed to do so. Moreover the union has given DPSM an ultimatum before to effect deductions by end of September 2016 are now demanding that DPSM effect the deductions immediately without fail and to recover the premiums of the month of September 2016.

“Members as a result of your failure are currently without cover and has also lost revenue it is entitled to and would have earned as a result of your omission. In the event you do not comply by end of October 2016, we will approach court and shall do so without further reference to yourselves and at your cost,” reads the letter.
