The Botswana Public Employees Union (BOPEU) contends that the Public Sector Bargaining Council (PBSC) acted unlawfully by continuing to admit the Botswana Federation of Public Sector Unions (BOFEPUSU) as a member.

In his founding affidavit, BOPEU president Andrew Motsamai avers that BOFEUSU cannot on its own right be admitted into the membership of the PSBC because the federation is not a recognised trade union as envisaged by Clause 6 [1] of the constitution of the PSBC. Motsamai also avers that it is the individual constituents of the PSBC who should be admitted first after that they would be at liberty to enter into “an acting jointly agreement” if they should so desire.

The constituents of BOFEPUSU are the Botswana Land Board and Local Authorities and Health Workers Union (BLLAHWU), the Botswana Sectors of Educators Trade Union (BOSETU), the Botswana Teachers Union (BTU) and the National Amalgamated Local and Central Government and Parastatal Workers Union (NALCGPWU).
