The councillor is facing a charge of threatening to kill after he uttered the words: "Ke tsile go bolaya ngwana wa gago ke go bolaya le wena (I will kill your son then you", to a certain Lebitso Richard Swapo. The incident is said to have taken place on June 16 in Sefhophe and was reported to Botshabelo Police on June 25. When the case came to court, the prosecutor, Sub-Inspector Kabelo Mozanywa of Botshabelo police requested the court to remand Bojalwa in custody to prevent him from carrying out his threats and interfering with police investigations. However, the magistrate turned down the request and stated that if Bojalwa is a real security threat as the police maintain, they could not have allowed nine days to elapse before he was arrested. Besides the P2,000 bail, the councillor is required to report to the nearest police station on a daily basis. The case resumes on July 27 when the state will call witnesses. Bojalwa is represented by Oganeditse Marata who dismissed the prosecution's grounds for remanding his client in custody. He argued that the alleged threat was not direct but was made through a cellphone. Marata called for thorough investigations of both the accused and the complainant and stressed that a one-sided story could prejudice his client's case. The prosecution said they could not arrest Bojalwa immediately because he was away in Serowe attending meetings.
