As a result, the managing director of Daisy Loo, Moemedi Dijeng, and some employees of Gaborone City Council (GCC) have been charged with conspiracy to defraud the council. The other accused are Frank Molaletsi, Gilbert Sithole, Frank Stegling and Bitsang Abbey.
Speaking to Monitor after the case was adjourned to October, Dambe said that among the witnesses would be the deputy mayor and chairman of the finance committee Ezekiel Dube, former city clerk Margaret Mabua, her successor Kutlwano Matenge, and some council employees in the sanitation department. The case had to adjourn so that the prosecution could furnish the defence with certain documents.
Former deputy city clerk Molefi Keaja completed his testimony on Friday when he told the court that he signed the three contracts for refuse collection and disposal for Daisy Loo, Cleaning Wizards and Base Agencies. He said that he was signing on behalf of Mabua who was out of office on other official commitments. He told the court that he learned that the Township Act requires the mayor and his deputy to sign the contract. He said that at the signing meeting in November 2003, which he chaired, it was also emphasised that the contractors and the council should cooperate during the duration of the tender. Representatives of the three companies including Dijeng attended the meeting. Keaja told the court that he only learnt in 2004 about the requirement in the Township Act on who should sign the contract. Defence lawyers did not cross examine the witness until the state had furnished them with all the documents. Dambe's prosecution team comprises Susan Mangori, Moakofi Seilane, Kopo Chibane, Kabelo Kedikilwe and Priscilla Israel. The defence lawyers are Duma Boko, Dick Bayford, Unoda Mack, Tebogo Sebego and Joao Salbany.
